General Policies

All condos have full kitchens, air conditioning, ceiling fans, washer/dryer & private lanais.   We supply a starter set of bathroom toiletries such as shampoo and paper products for your convenience.  We have several stores close by that you can purchase supplies as needed for you visit

Rental And Cancellation Policies

Cancellation Policies are stated below unless otherwise advertised at time of booking. General policies and terms of rental are listed below. 

Standard Policy

Free Cancellation until 30 days prior to arrival.  Cancellations between 30 and 14 days prior to arrival 50% refund. 

Deposit Policy: 1st night plus tax due at time of booking, Balance due in full 30 days prior.

Peak Season Policy December 15 To April 15.   

Free Cancellation until 60 days prior to arrival.   Cancellations between 60 and 30 days prior to arrival 50% refund. 

Deposit Policy: 1st night plus tax due at time of booking, Balance due in full 60 days prior.

General Reservation And Stay Policies

Trip Insurance is offered for all reservations and available on day of reservation or before final payment due.


A $25.00 nonrefundable Damage Waiver Fee is required for all reservations. Manager requires a valid credit card number on file in addition to the $25.00 Damage Waiver Fee. The Damage Waiver Fee is a nonrefundable Fee that relieves Guests of the cost for unintentional and accidental damage to the Rental Property and its contents, not to exceed the amount of coverage (up to $500.00 of unintentional damage). The Damage Waiver Fee does not cover intentional damage, theft, unauthorized entry into the owner’s supply closet, unauthorized pets, extensive cleaning required at check-out, smoking, exceeding occupancy limits or parking limits, and any other charges/polices in Manager’s Rental Policies and Rental Agreement including any fines imposed on Manager by the City, County, State or Home Owner Association as the result of violation of any law, ordinance, rule or regulation or any fines or costs levied against Guest or visitors of Guest (Excess Damage Costs). Guest will be notified of any Excess Damage Costs in writing. Any Excess Damage Costs will also be charged immediately to the Guest’s credit card. Guest, by signing below, assumes full responsibility for any items found to be missing and any damage due to misuse, negligence or action on Guest’s or Guest’s visitors part, except in the case of normal wear-and-tear reported to Manager within 24 hours of Check-in.

Carpet stains caused by the Guest that are immediately reported to Manager will be set up for prompt stain removal by a carpet cleaning company of our choice at no cost to Guest. However, if the stain(s) do not come out, then there may be an additional charge.

Resort Fee, Each reservation is subject to a one time $99 fee.  This fee helps to cover costs for the amenities of the property including internet, high definition television, gym access, on-site maintenance ,and caretaker.  Condominiums will also include items such as beach chairs, pool towels, high quality kitchen tools, and much more.  


1.     The property shall not be used by more than the number of people, infants included, listed in your reservation.

2.     All guests shall abide by local laws and shall not engage in illegal activity. Quiet hours are from 10 p.m. to 8 a.m.

3.     Pets are not permitted.  Service Animals as defined by the ADA are welcome.   We do ask owners to notify us as a courtesy.

4.     The responsible renter must be at least 21 years of age (or the specified minimum age required to rent the property, if higher). Guests under 21 years of age are welcome, but must be accompanied by a parent or legal guardian.

5.     Smoking or Vaping is permitted only in designated areas.  Absolutely not on Lanai Decks

6.     No commercial photography or filming is permitted on the property. Tents or other structures may not be erected without written approval from building manager.

7.     Renter is liable for any damage to the property and agrees to accept up to $500 USD charge to the card on file should damage occur during occupancy.   Damages excess of $500 USD to remain responsibility of renter.


A. Minimum Age. You must be at least 21 years of age to rent the Property. The Unit-Specific Terms may require a higher minimum age. You hereby confirm that you are at least (1) 21 years of age or (2) the age specified in any Unit-Specific Terms, whichever is higher. You agree to provide us with proof of age upon request. A parent or legal guardian must accompany all guests under 21 years of age for the entire duration of the rental.

B.  Responsible Renter. As the responsible renter, you agree to be an occupant of the Property for the entire duration of the rental. All other occupants will be family members, friends, other responsible adults over 21, or accompanied by a parent or legal guardian. You agree to be solely responsible for your actions and the actions of all family members, guests, and invitees (collectively, “Occupants”) present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the Terms.

C.  Good Neighbor Policy.  The Property is a privately owned home, and we enforce a good neighbor policy. Please treat the Property with the same care you would use with your own residence and leave it in the same condition it was in when you arrived. To prevent theft of or damage to furnishings or your personal property, you agree to close and lock doors and windows when you are not present at the Property and upon checkout. You and other Occupants agree to conduct yourselves throughout your stay in a manner that is respectful of and not disruptive to neighbors, traffic flow, or the community and that will not prompt complaints to Maui Sunset from police, neighbors, or neighborhood or homeowner associations. Noise audible outside the Property is prohibited between 10 p.m. and 8 a.m. You and other Occupants agree to abide by all applicable parking restrictions and limitations.

D. Maximum Occupancy.  The number of people present at the Property may not exceed the maximum posted occupancy unless we have given you advance permission to hold an event at the Property.

E.  No Smoking.  Smoking/Vaping is only permitted in designated areas.  There are two designated areas for each building located in grass near the parking lots.  The condos, walkways, including porches, decks and courtyards are a non-smoking area at any time. Maui County Code Section 13.04. 020  prohibits smoking on Beaches or any County Park. 

F.  Pets.  No pets of any kind are permitted at the Property except bona fide service animals we are required by law to allow. Prior notice must be given.

G. Events and Commercial Photography; Structures. Events and commercial photography or filming are prohibited at the Property without our express written permission. (If approved, additional conditions and fees may apply.) No tents or other structures may be erected on the property without our express written permission.

H. Criminal Activity Prohibited. Use of the Property for any criminal activity is prohibited and may result in fines or prosecution. This prohibition extends to use of the Property’s Internet service, if any, for criminal activity, including but not limited to unlawful downloads of copyrighted material, including movies, music, software, or other material. We will cooperate with any investigation of alleged criminal activity at the Property during your stay.


I. Early Check-In/Late Checkout.  Early check-in or late checkout may be available; additional charges may apply. If you do not vacate by checkout time (or late checkout time as agreed by ARM), you authorize us to bill your credit card on file for a late departure fee of up to one night’s rental and we may remove all Occupants and their personal property from the Property.

J. Maintenance or Housekeeping Issues; Property Conditions. The Property is provided as is, and we are not responsible for the inoperability or unavailability of any amenities. You agree to contact us as soon as you notice any maintenance or housekeeping problem, or any potentially hazardous condition, at the Property, or if any incident occurs at the Property that is related to such a problem or condition. We will take reasonable and appropriate steps to remedy any reported problem as soon as practicable. We may enter the Property at your invitation to remedy any problem you report, at reasonable times and with reasonable notice to inspect, maintain, or repair the Property, and to address any situation that we reasonably deem an emergency that threatens persons or property. You acknowledge that if the Property has access to amenities that are shared with other properties, such as a shared pool, hot tub, parking lot, or fitness center, that the availability and condition of those amenities is outside our control.

K. Indemnity. You agree to hold harmless and indemnify ARM and Owner for all claims for property damage, personal injury, or monetary loss resulting from your actions or omissions, and the actions or omissions of other Occupants, during your stay.

L. Substitution of Property. On extremely rare occasions, due to ownership changes, properties being removed from rental use, or a need for extensive repairs or maintenance, the Property may not be available for rental on the dates of your reservation. In this unlikely event, ARM reserves the right to substitute a comparable property. If comparable accommodations are not available, you will have the option of (1) selecting from other available properties (in which case you are responsible for, or will receive the benefit of, any difference in cost) or (2) receiving a complete refund of your reservation payment. In the event of a substitution of rental properties, all Terms in this Agreement, plus any Unit-Specific Terms specific to the substituted property, shall apply to your stay in the substituted property.
